| By booking with the English Travel Company you, and those on whose behalf you are booking, become party to a contract with ETC and those companies providing the services included in your holiday. ETC and The English Travel Company are trade names of The English Centre, Iskele Mahallesi, Ambarci Caddesi, Datça, Mugla, TURKEY. Registered number: 335 032 0736.
Your holiday includes only those travel services detailed on your booking confirmation and nothing else. All details on this website are provided for your information only and items not specified in your holiday booking may not be construed as being included in the price of your holiday. Unused services are non-refundable.
These terms and conditions govern all Bookings that you make with us.
Terms & Conditions : If you book through us, we will accept your booking in our capacity as a booking agent for the relevant supplier(s) (e.g. the hotel supplier) concerned and your contract will be subject to the supplier's terms and conditions (which may limit or exclude liability often in accordance with international conventions). Booking: If you book a Holiday or Other Holiday Arrangement twelve (12) weeks or less before the commencement of your Holiday or Other Holiday Arrangement, we require immediate full payment for your Holiday or Other Holiday Arrangement. No contract shall come into existence between us until we accept your Order and we have received full payment from you. On receipt of your Order we will send you a "confirmation of request" summarising the details of your Order, and a booking reference (which you should quote when making any correspondence with us).
When you make a Booking with us, and by submitting your Order to us, you guarantee that you have the authority to accept (and do so accept) these conditions on your behalf and on behalf of all members of your party. Further, if you are making a Booking for more than one person, you guarantee that you are responsible for all payments due from each and every party member for whom you are making a Booking.
Once we have received your booking request and have responded with a confirmed price for your holiday we can guarantee that this price is accurate and will be held for 48 hours from the time of our return email to you. Government taxes and fuel surcharges are not included in this guarantee. When you have booked your holiday and paid your deposit you will not have to pay any more because the value of the pound has changed.
Bookings made through our Telesales Service: If you make a Booking through our Telesales Service you must provide us with all information that we require. You must ensure that all information which you provide to us in your Order is accurate and correct and that the credit or debit card you are using is your own (or if it is a third party's, that you have their express authorisation as confirmed to us in advance in writing, to use their credit or debit card) and that sufficient funds are available to cover the cost of the Holiday or Other Holiday arrangement which you book with us. Payment: We require full payment details, or a non-refundable minimum deposit of 10% of your total Holiday or Other Holiday Arrangement price, from you at the time that you make your Order to us for a Holiday or Other Holiday Arrangement. Full payment must be received by ETC a minimum of three (3) weeks before your holiday is due to begin, or the booking may be cancelled and cancellation charges applied. Payment can be made using any major credit or debit card, by cheque (please note that we will require 10 business days to clear payments made by cheque) or by bank draft. Your verbal authorisation of the use of your credit or debit card indicates your compliance with our booking terms and conditions and confirms your reservation whether or not you have actually signed a sales voucher. If you wish to make changes: We will endeavour to assist you if you need to alter your Booking made for a Holiday or Other Holiday Arrangement. You may make alterations to your Order for a Holiday or Other Holiday Arrangement free of charge, up to 21 days before the start of your holiday, so long as you notify us of the required alterations, together with your booking reference number. If, after Booking, due to events beyond your control, you or any member of your party are unable to proceed with your Holiday, you can transfer the Booking to a substitute person, provided that person satisfies all the conditions applicable to your particular Holiday and that your request is received in writing by our Customer Service Manager at the above address no later than 60 days before the commencement of your Holiday. The transfer notice must be signed by the person who made the Booking and must enclose the administrative fee of £100 per person. Both the person taking and the person withdrawing from the Booking will be responsible for paying any additional costs arising from the requested transfer, such as any extra charges imposed by a service provider of a part of your Holiday or Other Holiday Arrangement.
If you need to cancel: The following cancellation penalties apply from the date we are advised of your cancellation: 45 days or more prior to departure: £100 per person 44 to 22 days prior to departure: 50% of total price 21 days or less prior to departure: 100% of total price
Penalties are applied on the quoted holiday price plus all applicable taxes. All rights of cancellation, alteration and the accompanying charges, for Telesales and Online Booking in these conditions are subject to any limitations and charges imposed by our supplier and we reserve the right to limit the terms of such conditions and/or raise the charges specified in accordance with our suppliers' terms and conditions and to pass on to you any costs imposed on us by suppliers in respect of any alteration or cancellation made by you.
Our alteration of your Holiday or Other Holiday Arrangement: We reserve the right to change the price and/or description of any Holiday or Other Holiday Arrangement before a Booking is made and full payment has been received by us. Occasionally it may be necessary to make changes to the details of your Holiday or Other Holiday Arrangement booked with us, even after confirming your booking . Any such changes are likely to be minor, and we reserve the right to make minor changes without further notification to you. If a major change is necessary, we will inform you as soon as reasonably possible if there is time before your Holiday or Other Holiday Arrangement commences. If a major change is necessary, we will offer you the choice of: (a) accepting the amendment as notified; or (b) purchasing another Holiday or Other Holiday Arrangement from us with the price difference payable/refundable as appropriate; or (c) cancelling your Package. Once we have notified you of a major change you must communicate your decision to us within seven (7) days of your receipt of such notification. Major changes include:
- Change of accommodation standard
- Increase in your Holiday or Other Holiday Arrangement cost by more than 7% (unless government imposed)
- If there is an error in published rates
Sometimes the accommodation reserved is not available for reasons such as unexpected maintenance problems or overbooking, and a substitute residence of equal or greater quality is provided. If the accommodation standard is downgraded, this will be considered a major change, and a refund for any difference in price will be offered in the first instance. Documentation: It is your responsibility to ensure you have the identification, and all other documents, necessary for travel to your destination and it is your responsibility to obtain, at your own expense, such documentation. We strongly recommend that you travel with a valid passport (valid at least 6 months beyond your return date). If your travel documents are not in order you may be refused entry to Turkey; you will be responsible for any costs incurred and no holiday refund will be issued. Please ask us for details, if you are unsure.
Special Requests: We will do our best to convey your special accommodation requests and other requirements but these are strictly at the discretion of the hotel, pansiyon or apartment and may be subject to surcharges payable locally. The English Travel Company is not responsible if these special requests are not met, although notification will be given where possible. Travellers with Specific Needs: ETC must be advised of special requirements at the time of booking and we will make every effort to accommodate special requests, but cannot confirm a reservation until all travel suppliers have acknowledged that they can provide the services requested. There may be an extra charge for some services. Passengers with any infirmity that is likely to require special equipment during their journey, or after arrival at their destination, must detail their precise needs before booking. Holiday Insurance: In the case of cancellation due to health problems or unforeseen circumstances, it is extremely important that all vacationers be insured. We strongly recommend that you purchase holiday insurance, and reserve the right not to accept an Order without proof of travel insurance. The English Travel Company cannot be held liable for any losses, damages or claims that could normally be expected to be covered by travel insurance, where the traveller has chosen not to take such insurance. The English Travel Company reserves the right to:
- Cancel holiday arrangements before their commencement, in which case ETC's liability shall be restricted to promptly refunding all monies received on account of the cancelled bookings.
- Refuse a booking and return the deposit to the customer.
- Refuse to supply or to continue a travel service where the traveller is in violation of a supplier's terms and conditions; when it is anticipated that the traveller will be a security risk to any other passengers or is likely to disrupt their quiet enjoyment; if they are without proper documentation; if directed to do so by an authority with power; if brought about by ‘force majeur’. Should any of these circumstances apply, ETC's obligation will be limited to the refund of any unused part of the Holiday or Other Holiday Arrangement costs that we are able to recover from the suppliers of travel services, less a reasonable communication and administration fee.
The English Travel Company makes arrangements with: Car rental companies and other suppliers to provide you with travel services; the services such companies supply are subject to their own terms and conditions and agreements or customs of their business. Once travel has commenced, ETC cannot assume responsibility for any refunds, losses, damage, costs or expenses arising out of injury, accident or death, loss or damage to or delay, inconvenience, upset, disappointment, stress, frustration or loss of enjoyment or loss of Holiday or Other Holiday Arrangement time resulting from: a. The act or fault or omission by any party other than by ETC or its employees b. Traveller’s failure to provide documentation necessary for the journey to Turkey and return to their home country c. Being held by Government, or other competent authority, direction d. The traveller missing connections or failing to follow the directions of ETC or its representative.
No representative of ETC, its suppliers or any Travel Agent has the authority to modify or waive any provision of this agreement. Claims: The passenger agrees that any claim against ETC shall be made by the passenger in writing and received by ETC no later than 30 days after the event causing the claim. Claims or demands made after 30 days will not be responded to. Claims must be in writing and sent by registered mail to the ETC address given above, prior to the submission of any legal claim. Under no circumstances shall you claim from ETC an amount in excess of the costs of the vacation paid by you. Law: A person who is not a party to these terms and conditions shall have no rights under the Contracts (Rights of Third Party Act 1999) to enforce any term of this Agreement. This paragraph does not affect any right or remedy that exists or is available otherwise than pursuant to that Act. These terms and conditions shall be governed and construed in accordance with English law and the English courts shall have exclusive jurisdiction to adjudicate any dispute that arises thereto. What particular expressions mean: Booking: An Order made by you for the purchase of a Holiday or Other Holiday Arrangement with or through us, which is accepted by us in accordance with these terms and conditions. Force Majeur: War, threat of war, riot, civil disobedience or strife, industrial dispute, supplier insolvency, terrorist activity, natural, nuclear or industrial disaster, epidemics or health risks, fire, adverse weather conditions, level of water in rivers, technical or maintenance problems with transfer, unforeseen operational decisions of air carriers such as changes of schedule, or any unforeseeable or unavoidable events beyond our control. Online: Our online booking services which are made available through our website "www.englishtravelcompany.com", where we make Holiday or Other Holiday Arrangements available to you for purchase. Other Holiday Arrangement: Any other booking that is not a Holiday (e.g. a cruise only, car hire and train tickets, booked with us as individual components, regardless as to whether components were purchased at the same time). Holiday : A combination of at least two of the following: (a) transport (b) accommodation (c) another tourist service which forms a significant part of your Booking, providing that those two or more components, pre-arranged by us, are sold to you at the same time by us at an inclusive price with full payment being made to us. ETC, the English Travel Company, we, our, ourselves, us: The English Centre either trading as itself or utilising its trading name of "ETC" or “The English Travel Company”, whose registered office is at Iskele Mahallesi, Ambarci Caddesi, Datça, Mugla, TURKEY. You, your, yourself: Any person who makes a Booking for a Holiday or Other Holiday Arrangement, either directly (as principal) or indirectly (as another beneficiary), with us.
